    Automated legal sensemaking: the centrality of relevance and intentionality

    Introduction: In a perfect world, discovery would ideally be conducted by the senior litigator who is responsible for developing and fully understanding all nuances of their client’s legal strategy. Of course today we must deal with the explosion of electronically stored information (ESI) that never is less than tens-of-thousands of documents in small cases and now increasingly involves multi-million-document populations for internal corporate investigations and litigations. Therefore scalable processes and technologies are required as a substitute for the authority’s judgment. The approaches taken have typically either substituted large teams of surrogate human reviewers using vastly simplified issue coding reference materials or employed increasingly sophisticated computational resources with little focus on quality metrics to insure retrieval consistent with the legal goal. What is required is a system (people, process, and technology) that replicates and automates the senior litigator’s human judgment. In this paper we utilize 15 years of sensemaking research to establish the minimum acceptable basis for conducting a document review that meets the needs of a legal proceeding. There is no substitute for a rigorous characterization of the explicit and tacit goals of the senior litigator. Once a process has been established for capturing the authority’s relevance criteria, we argue that literal translation of requirements into technical specifications does not properly account for the activities or states-of-affairs of interest. Having only a data warehouse of written records, it is also necessary to discover the intentions of actors involved in textual communications.     Laboratory Rearing of \u3ci\u3eLycaeides Melissa Samuelis\u3c/i\u3e (Lepidoptera: Lycaenidae), An Endangered Butterfly in Michigan

    The Karner blue butterfly (Lycaeides melissa samuelis) is listed as a federally endangered species in the United States. It occurs in oak savanna and pine barren habitats from eastern Minnesota to New Hampshire. In 1994, we successfully reared Karner blue larvae under controlled laboratory conditions for experimental purposes, and report on those rearing methods here. We collected 20 female Karner blue adults of the spring generation from two areas in Michigan, and housed them in cages in an environmental chamber at 240 -26°C for 5 days. The female butterflies produced 154 eggs, of which 72 hatched in an average of 4.5 days, and 68 first instars survived. Eggs, larvae and pupae were kept in a growth chamber at 24°C. Developmental time from egg to adult averaged 26 days; the average duration of each instar ranged from 3 to 4 days, and the average pupal duration was 8 days. Thirty three lab- oratory-reared Karner blue larvae successfully completed the 4 instars, and were released as adults into maternal collection sites. Laboratory rearing may be a viable means of providing Karner blue individuals for reintroduction into areas where the species is extirpated, for supplementation of small populations, or for research. Ultimately, such methods may become an integral part in the recovery of this and other rare invertebrate species

    Exploratory Survey for the Emerald Ash Borer, \u3ci\u3eAgrilus Planipennis\u3c/i\u3e (Coleoptera: Buprestidae), and Its Natural Enemies in China

    An exploratory survey for the emerald ash borer, Agrilus planipennis, and its natural enemies was conducted in China during October and November 2003. We examined 29 field plots in six provinces. We visually inspected living Fraxinus chinensis, F. mandshurica, F. pennsylvanica, F. rhynchophylla, and F. velutina then peeled off the bark in search of A. planipennis and associated natural enemies. We found active A. planipennis infestations in nine of the 29 field plots, including plots in the provinces of Hebei, Heilongjiang, Jilin, Liaoning, and the provincial level city of Tianjin. Signs of past A. planipennis infestations were found in five of the 20 plots where no active infestations were present. The distribution of A. planipennis was patchy within the forest, and larval densities varied greatly among trees and at different heights within the same tree. Agrilus planipennis densities ranged from 0 to 284 larvae/m2 of bark surface for 1-m log sections. The Nearctic ash species, F. pennsylvanica and F. velutina, planted in China were apparently more susceptible to A. planipennis attack than were the native Chinese ash species. Similarly, ash trees growing along streets or in plantations or city parks were more susceptible to A. planipennis infestation compared with trees in natural forests. We identified two species of natural enemies attacking A. planipennis during this survey. In Changchun City, Jilin Province and Guangang District, Tianjin City, we found a previously reported but undescribed species of Spathius sp. (Braconidae) parasitizing an average of 6.3% A. planipennis larvae in individual trees, ranging from 0 to 50%. In Changchun City, Jilin Province and in Benxi County, Liaoning Province, we discovered a previously unknown gregarious endoparasitoid of A. planipennis larvae, Tetrastichus nov. sp. (Eulophidae), with a total parasitism rate of 6.6% in individual trees, ranging from 0 to 50%. We discussed the potential role of natural enemies in the management of A. planipennis in North America

    \u3ci\u3eAnoplophora Glabripennis\u3c/i\u3e Within-Tree Distribution, Seasonal Development, and Host Suitability in China and Chicago

    Established populations of the Asian longhorned beetle, Anoplophora glabripennis (Motschulsky) (Coleoptera: Cerambycidae), were first reported in the United States in New York in 1996, Illinois in 1998, and New Jersey in 2002. A federal quarantine and an eradication program were implemented in 1997, involving tree surveys and removal of infested trees. We recorded the number of A. glabripennis life stages found at several locations along the main trunk and major branches of naturally infested trees in China (species of Populus, Salix, and Ulmus) and Chicago, Illinois (species of Acer, Fraxinus, and Ulmus) during 1999 to 2002. Typically, A. glabripennis initiated attack near the crown base along both the trunk and main branches. The one exception to this pattern was on Populus trees in China that had branches along the entire trunk, in which case A. glabripennis initiated attack along the lower trunk. Larvae were the dominant overwintering stage in both countries. A host suitability index for A. glabripennis was calculated for each tree with the formula: (number of living life stages + number of exit holes) / number of oviposition pits. The mean host suitability index was higher on Populus and Salix than Ulmus in China, and generally higher on Acer and Ulmus than Fraxinus in Chicago. Eleven genera of trees (N = 1465 trees) were infested by A. glabripennis in Chicago; in decreasing order of tree frequency they included Acer, Ulmus, Fraxinus, Aesculus, Betula, Salix, Celtis, Malus, Pyrus, Sorbus, and Tilia. When the proportion of each genus of infested street trees (N = 958 trees in 7 genera) was compared to its proportion of all Chicago street trees based on a 2003 inventory (N = 539,613 trees in 45 genera), A. glabripennis showed a significant preference to infest the genera Acer and Ulmus. Based on our results, inspectors should focus their efforts on upper trunks and lower branches of Acer and Ulmus trees

    Bridging the Technology Readiness "Valley of Death" Utilizing Nanosats

    Incorporating new technology is a hallmark of space missions. Missions demand ever-improving tools and techniques to allow them to meet the mission science requirements. In Earth Science, these technologies are normally expressed in new instrument capabilities that can enable new measurement concepts, extended capabilities of existing measurement techniques, or totally new detection capabilities, and also, information systems technologies that can enhance data analysis or enable new data analyses to advance modeling and prediction capabilities. Incorporating new technologies has never been easy. There is a large development step beyond demonstration in a laboratory or on an airborne platform to the eventual space environment that is sometimes referred to as the "technology valley of death." Studies have shown that non-validated technology is a primary cause of NASA and DoD mission delays and cost overruns. With the demise of the New Millennium Program within NASA, opportunities for demonstrating technologies in space have been rare. Many technologies are suitable for a flight project after only ground testing. However, some require validation in a relevant or a space flight environment, which cannot be fully tested on the ground or in airborne systems. NASA's Earth Science Technology Program has initiated a nimble program to provide a fairly rapid turn-around of space validated technologies, and thereby reducing future mission risk in incorporating new technologies. The program, called In-Space Validation of Earth Science Technology (InVEST), now has five tasks in development. Each are 3U CubeSats and they are targeted for launch opportunities in the 2016 time period. Prior to formalizing an InVEST program, the technology program office was asked to demonstrate how the program would work and what sort of technologies could benefit from space validation. Three projects were developed and launched, and have demonstrated the technologies that they set out to validate.
